스페인 주재 북한대사관에 침입한 혐의로 스페인 신병 인도 결정이 내려진 크리스토퍼 안 씨의 변호인이 안 씨의 보석조건을 완화해 줄 것을 재판부에 요구했습니다. 보석 조건을 성실히 이행하며 도주 의사가 없다는 점을 분명히 해 왔다는 이유를 들었습니다. 함지하 기자가 보도합니다.
Christopher Ahn's lawyer, who was sentenced to extradition from Spain for breaking into the North Korean Embassy in Spain, has called on the court to ease Ahn's bail conditions. I heard that he has faithfully fulfilled the bail conditions and made it clear that he has no intention of escaping. Ham Ji-ha reports.

크리스토퍼 안 씨의 변호인은 지난 12일 미 법원에 제출한 문건을 통해 안 씨의 보석조건이 완화될 필요가 있다고 주장했습니다.
Christopher Ahn's lawyer said in a document filed with the U.S. court on the 12th that Ahn's bail conditions need to be eased.

미국 법원 전자 기록시스템에 따르면 안 씨 측 변호인단은 이 문건에서 ‘형사 소송 절차에서 개인의 도주 위험 여부를 판단할 땐 행동이 말보다 중요하다’는 과거 판례 문구를 언급하며 가택연금 기간 안 씨의 행동은 이 같은 사례를 명확하고 분명하게 보여준다고 말했습니다.
According to the U.S. court's electronic records system, Ahn's lawyers said in the document that actions are more important than words when determining whether an individual is at risk of escape in criminal proceedings.

안 씨는 지난 2019년 2월 스페인 주재 북한대사관에 침입해 납치극을 벌인 혐의로 같은 해 4월 스페인 수사당국의 요청을 받은 미국 연방수사국에 체포됐으며, 이후 미 법원은 외출 시간을 오전 8시부터 자정까지로 제한하고 자택을 기준으로 반경 80km 이내에서만 활동하는 것을 조건으로 한 가택연금을 명령한 바 있습니다.
Ahn was arrested by the U.S. Federal Bureau of Investigation in April 2019 on charges of breaking into the North Korean Embassy in Spain and kidnapping. A U.S. court has ordered a house arrest on condition that he limits his time out to 8 a.m. to midnight and only works within a radius of his home.

가택연금 상태에서 재판을 받던 안 씨는 지난 5월 미 캘리포니아 중부 연방법원으로부터 스페인 신병 인도 결정을 받았으며, 이에 반발한 안 씨 측은 미 연방법 집행기관인 미국 보안국(US Marshal)을 상대로 안 씨의 인신보호 청원을 청구했습니다.
Ahn, who was on trial under house arrest, was extradited to Spain by a federal court in central California in May, and Ahn's counterpart filed a petition against the U.S. Marshal, the U.S. federal law enforcement agency.

인신보호 청원은 미 연방기관에 의한 특정인의 구금에 대해 법원이 ‘적법성’을 판단해 줄 것을 요청하는 절차로, 법원이 안 씨의 구금이 적법하지 않다고 판단할 경우 안 씨의 스페인 신병 인도는 자동적으로 취소됩니다. 하지만 반대의 결정이 내려질 경우 안 씨는 구치소로 옮겨져 신병 인도 절차를 밟아야 합니다.
A plea for protection is a process that asks the court to determine the legality of the detention of a particular person by a U.S. federal agency, and Ahn's extradition to Spain will be automatically canceled if the court determines that his detention is not legitimate. However, if the opposite decision is made, Ahn will have to be transferred to the detention center for extradition.

변호인은 가택연금 기간인 1천 128일 동안 안 씨가 보석 조건을 단 한 차례도 위반한 적이 없다고 강조했습니다.
The lawyer stressed that Ahn has never violated the bail conditions for 1,128 days during his house arrest.

특히 외출과 활동범위에 대한 보석조건을 지킨 사실과 더불어 매일 사법당국 관계자와 화상통화를 한 점, 대사관 침입사건 혐의로 함께 기소된 반북단체 자유조선 관계자 에이드리언 홍 창 등 어떤 누구와도 연락하지 않았다는 점 등을 보석 조건이 완화돼야 할 이유로 꼽았습니다.
In particular, he cited the fact that he kept bail conditions for going out and activities, video calls with law enforcement officials every day, and that he did not contact anyone, including Adrian Hong Chang, an anti-North Korean group accused of invading the embassy.

그러면서 구체적으로 안 씨의 발목에 채워진 추적 장치를 풀고 외출 제한 시간을 철폐하며 이동 가능 범위도 캘리포니아 중부 연방법원 관할 지역으로 넓혀줄 것 등을 요청했습니다.
He specifically asked for Ahn's ankle-filled tracking device to be released, the curfew to be lifted, and the travel scope to be extended to the jurisdiction of the federal court in central California.

아울러 대사관 침입사건과 연관이 없는 미국의 대북 인권단체 ‘링크(LINK· Liberty in North Korea)’ 관계자들과 교류를 금지한 조치를 해제하는 한편 침입 사건에 직접적으로 연루된 인사를 제외한 자유조선 관계자 등과도 접촉을 허가해 달라는 내용을 요청서에 담았습니다.
In addition, the request was to lift the ban on exchanges with officials of the U.S. human rights group LINK (Liberty in North Korea), which is not related to the embassy intrusion, and to allow contact with free Joseon officials except those directly involved in the intrusion.

또 안 씨의 신병인도 결정이 내려지기까지 앞으로 수년이 더 걸릴 것으로 예상된다는 점도 보석조건 완화를 요구하는 배경으로 제시했습니다.
He also suggested that Ahn's recruitment is expected to take several more years before the decision is made as a background for demanding easing bail conditions.

이 같은 요청에 아직까지 재판부는 최종 결정을 내리지 않았습니다.
The court has yet to make a final decision on the request.

이와는 별도로 안 씨의 스페인 신병 인도 절차를 담당한 미국 보안국이 안 씨 측 요구에 반대 의견을 제시하지 않을지도 주목해서 지켜볼 부분입니다.

앞서 지난 5월 안 씨의 신병인도를 허가한 담당 판사는 법에 따라 안 씨의 신병 인도를 승인하지만 그것이 옳은 결정이 아니라면서 상급심이 자신의 결정을 뒤집길 바란다는 이례적인 의견을 제시한 바 있습니다.
Earlier in May, the judge in charge of granting Ahn's extradition approved him under the law, but said it was not the right decision and offered an unusual opinion that he wanted the upper court to reverse his decision.
