미 전문가들, 윤 대통령 ‘탈북어민 북송사건’ 조사 필요성 언급에…“국제법·헌법 위반 바로 잡는 일” > 정치

윤석열 한국 대통령이 3년 전 발생한 탈북 어민 북송 사건의 진실에 대한 조사 필요성을 언급한 것과 관련해 미국 내 인권 전문가들은 국제법과 한국 헌법 위반을 바로잡는 일이라며 환영했습니다. 한국 정부가 관련 사건을 철저히 조사해 그 결과를 한국뿐 아니라 국제사회에 공개해야 한다는 점도 강조했습니다. 안소영 기자입니다.
U.S. human rights experts welcomed South Korean President Yoon Seok-yeol's mention of the need to investigate the truth of the repatriation of North Korean defectors three years ago, calling it a corrective action against international law and the Korean Constitution. He also stressed that the Korean government should thoroughly investigate related cases and disclose the results not only to Korea but also to the international community. I'm reporter Ahn Soyoung.

로버트 킹 전 국무부 북한인권특사는 윤석열 한국 대통령이 탈북어민 북송 사건에 대한 재조사 필요성을 언급한 것을 (한국 정부의 대북) 정책 변화 신호로 풀이했습니다.
Robert King, former special envoy for North Korean human rights at the State Department, interpreted South Korean President Yoon Seok-yeol's mention of the need to reinvestigate the repatriation of North Korean defectors as a sign of a change in policy.

[녹취: 킹 전 특사] “It’s an indication of a change of the policy and it does make sense. It was very controversial at that time the way it’s done. It seems to me that there were ways of dealing with issues like that with questions of a crime. South Korea has an excellent legal system and the individuals could be put on trial. There were more balanced and appropriate way of handing it.”

킹 전 특사는 21일 VOA와의 전화통화에서 당시 관련 사건의 처리 방식에 대해 큰 논란이 있었다며, (북송 이유로 제기됐던) 탈북 선원들의 범죄 여부를 다룰 방법들이 있었다고 지적했습니다.
In a telephone interview with VOA on the 21st, King said there was a big controversy over how the case was handled and pointed out that there were ways to deal with the crimes of North Korean defectors.

한국은 훌륭한 법률 제도를 갖추고 있으며 탈북 선원들을 재판에 넘겨 보다 공정하고 적절하게 대우할 수 있었다는 겁니다.
South Korea has a good legal system and has been able to bring North Korean defectors to justice and treat them more fairly and appropriately.

앞서 한국 문재인 정부는 지난 2019년 11월 동해 북방한계선(NLL) 이남 지역에서 나포된 뒤 한국에 망명 의사를 밝힌 북한 선원 2명을 조사한 후 이들이 동료 선원 16명을 살해한 흉악범으로 알려져 북한으로 추방했다고 밝혔습니다.
The South Korean Moon Jae In government earlier said it investigated two North Korean sailors who expressed their intention to defect to South Korea after being captured in November 2019 in the southern part of the Northern Limit Line (NLL) and deported them to North Korea.

한국 정부는 당시 이들이 살인 등 중대한 비정치적 범죄자로 보호 대상이 아니며 한국 편입 시 국민의 생명과 안전 위협, 국제법상 난민으로도 인정할 수 없어 추방을 결정했다고 설명했지만, 적법 절차 없이 북송해 생명권을 침해했다는 비판이 제기됐었습니다.
The South Korean government explained that they were not protected as serious non-political criminals such as murder, and that they could not be recognized as refugees under international law when they entered the country, but criticism was raised that they violated their right to life.

이와 관련해 윤석열 대통령은 탈북 어민 사건에 대한 진상규명 요구와 관련해 21일 출근길 기자들을 만난 자리에서 "아직 검토 중인데, 원래 옛날부터 좀 국민이 문제를 많이 제기하지 않았나"라고 말했습니다.
President Yoon Seok-yeol said in a meeting with reporters on his way to work on the 21st, "We are still considering it, but haven't the people raised a lot of questions since a long time ago?"

그러면서 "일단 우리나라에 들어왔으면 우리 헌법에 따라 대한민국 국민으로 간주된다"고 지적했습니다.
He pointed out, "Once you enter our country, you are considered a Korean citizen according to our Constitution."

필 로버트슨 휴먼라이츠워치 아시아 담당 부국장은 21일 VOA에 보낸 공식 성명을 통해 윤 대통령의 관련 움직임을 환영했습니다.
Phil Robertson, Asia's deputy director of Human Rights Watch, welcomed Yoon's move in an official statement to VOA on Monday.

[로버트슨 부국장] “President Yoon is correct to revisit this and other highly suspect decisions by the Moon Jae-in government to try to appease Pyongyang. It’s time to set the record straight on just how craven President Moon was in dealing with the North, and the extent which he bent over backwards to mollify DPRK leader Kim Jong-un in his vain attempts to try and restart the North-South political dialogue.”
[Assistant Director Robertson] "윤 대통령이 북한을 달래기 위해 문재인 정부가 내린 이 결정과 다른 매우 의심스러운 결정들을 다시 한 번 검토하는 것은 옳습니다. 문 대통령이 대북 문제에 얼마나 담담했는지, 김정은 북한 국무위원장의 남북 정치대화 재개를 위한 헛된 시도에서 얼마나 허리를 굽혀 진정시켰는지 그 기록을 바로 세워야 할 때입니다.

로버트슨 부국장은 “윤 대통령이 문재인 정부가 북한을 달래기 위해 내린 이 결정과 다른 매우 의심스러운 사건에 대한 결정을 재검토하는 것은 옳은 일”이라고 말했습니다.
"President Yoon is right to review this decision made by the Moon Jae In government to appease North Korea and other highly suspicious cases," Robertson said.

그러면서 “이제는 문 대통령이 북한을 얼마나 비겁하게 대했는지, 더 나아가 남북 간 정치적 대화 재개를 위한 헛된 시도에서 북한 지도자 김정은을 달래기 위해 어떻게 했는지 등 관련 기록을 바로 잡을 때”이라고 덧붙였습니다.
He added, "It is time to correct related records, such as how President Moon treated North Korea cowardly, and furthermore, how he did to appease North Korean leader Kim Jong-un in a futile attempt to resume political dialogue between the two Koreas."

이어 “탈북을 시도한 북한 선원 2명은 처형됐거나 관리소로 보내져 죽을 때까지 일해야 하는 상황에 놓였을 가능성이 있어 이들을 위해 할 수 있는 일은 없지만, 윤 대통령이 이들의 탈북 과정에 대한 종합적인 조사를 지시하는 것은 전적으로 올바른 일”이라고 말했습니다.
"The two North Korean sailors who attempted to defect may have been executed or sent to the management office to work until they die, so there is nothing they can do for them, but President Yoon is absolutely right to order a comprehensive investigation into their defection process."

[로버트슨 부국장]”While there is nothing that can be done for those two North Korean fishermen who tried to defect because they have likely either been executed or sent to the kwanliso to be worked to death, it’s entirely appropriate for President Yoon to order a comprehensive investigation of how their case was handled by South Korean officials.”
[Assistant Director Robertson] 북한 어민 2명이 처형되거나 관리소로 보내져 사망했을 가능성이 높기 때문에 탈북을 시도한 것은 어쩔 수 없지만, 윤 총장이 이들의 사건이 어떻게 처리됐는지에 대한 종합적인 조사를 지시하는 것은 전적으로 적절합니다."

아울러 “한국 법원에서 관련 사건에 대한 재판이 진행됐더라면 최소한 공정성과 적법한 절차 가능성이 있었을 것”이라며 “인권변호사인 문 대통령이 그 점을 인지했어야 했다”고 로버트슨 부국장은 지적했습니다.
"If the trial had been conducted in the Korean court, there would have been at least a possibility of fairness and due process," said Deputy Director Robertson. "President Moon, a human rights lawyer, should have recognized that."

[로버트슨 부국장]“If the case had been tried in a South Korean court, there was at least the possibility of fairness and due process, and human rights lawyer President Moon should have realized that. Sadly, it appears that President Moon saw these two men’s lives as nothing more than an opportunity to trade something for more sympathetic engagement with Pyongyang. That profoundly immoral stance from the ROK leadership effectively condemned those two fishermen to death once they were returned to the North.”
[Assistant Director Robertson] 한국 법원에서 재판이 진행됐더라면 최소한 공정성과 적법한 절차의 가능성은 있었고, 인권변호사 문 대통령은 그걸 깨달았어야 했습니다. 안타깝게도, 문 대통령은 이 두 사람의 삶을 북한과 더 우호적인 관계를 위해 무언가를 교환하는 기회로 본 것 같습니다. 한국 지도부의 매우 부도덕한 입장은 북한으로 송환된 두 어부들을 사실상 사형에 처했습니다."

로버트슨 부국장은 그러면서 “문 대통령은 안타깝게도 선원 2명의 삶을 북한과의 우호적 관계를 위한 일종의 교환의 기회로 여긴 것 같다”며 “한국 지도부의 매우 부도덕한 조치는 북한 선원 2명을 북송함으로써 사실상 사형을 선고한 것과 다름없다”고 주장했습니다.
"Unfortunately, President Moon seems to have seen the lives of two sailors as a kind of exchange for friendly relations with North Korea," Robertson said. "The South Korean leadership's very immoral move is practically a death sentence by sending two North Korean sailors back to the North."

대북 제재와 인권 전문 변호사인 조슈아 스탠튼 변호사는 당시 문재인 정부의 결정은 국제법과 한국 헌법에 대한 위반을 시사한 것이었다며, 윤 대통령은 이번 사건에 대해 투명한 조사를 벌여야 한다고 말했습니다.
Joshua Stanton, a lawyer specializing in sanctions and human rights against North Korea, said the Moon Jae In government's decision at the time suggested a violation of international law and the Korean Constitution, and that President Yoon should conduct a transparent investigation into the case.

[스탠튼 변호사] “The 2019 case shocked human rights NGOs because the Moon administration denied the men any legal process in which they could make a claim of asylum and instead relied on unverified North Korean government claims that the men were murderers. These facts strongly suggest that the South Korean government, then led by a former human rights lawyer, violated several domestic and international human rights laws, including the UN Refugee Convention and the UN Convention Against Torture.
[Stanton's lawyer] "2019년 사건은 인권 NGO들에게 충격을 주었습니다. 왜냐하면 문재인 정부는 그 남성들이 망명 신청을 할 수 있는 어떠한 법적 절차도 부인하고 대신 그 남성들이 살인자라는 검증되지 않은 북한 정부의 주장에 의존했기 때문입니다. 이러한 사실들은 당시 인권변호사였던 한국 정부가 UN난민협약과 UN고문방지협약 등 여러 국내외 인권법을 위반했음을 강력하게 시사하고 있습니다.

스탠튼 변호사는 2019년 인권단체들은 문재인 정부가 선원들의 망명 신청을 받아들일 수 있는 법적 조치를 취하는 대신 살인자라는 검증되지 않은 북한의 주장에 의존한 데 충격을 받았었다고 설명했습니다.
Stanton explained that in 2019, human rights groups were shocked by the Moon Jae In government's reliance on an unverified North Korean claim that it was a murderer instead of taking legal action to accept the sailors' asylum claims.

또한 이 같은 사실들은 전직 인권변호사 출신의 한국 대통령을 둔 정부가 유엔난민협약과 유엔고문방지협약 등 국내외 여러 인권법을 위반했음을 강하게 시사한다고 설명했습니다.
They also strongly suggest that the Korean government, a former human rights lawyer, violated human rights laws at home and abroad, including the United Nations Convention on Refugees and the United Nations Convention on the Prevention of Torture.

스탠튼 변호사는 이에 따라 윤 대통령은 이제 이번 사건에 대한 철저한 조사를 지시하고 상세한 조사 결과를 한국 국민뿐 아니라 국제사회에 공개해야 한다고 덧붙였습니다.
Stanton added that President Yoon should now order a thorough investigation into the case and disclose the detailed findings not only to the Korean people but also to the international community.

그레그 스칼라튜 미국 북한인권위원회 사무총장은 윤 대통령의 이번 언급은 대북 정책과 관련한 책임 있는 지도력을 보여준다고 말했습니다.
Greg Skalatu, secretary general of the U.S. Commission on North Korean Human Rights, said Yoon's comments show responsible leadership in North Korea's policy.

스칼라튜 사무총장은 북한 선원을 강제 송환한 사건은 지난 1951년 채택된 유엔난민협약과 1967년 채택된 선택의정서를 위반한 것이며, 또한 북한 주민들도 한국 국적자로 보는 한국 헌법의 가치를 부정한 것이나 다름없었다고 말했습니다.
Scaratu says the forced repatriation of North Korean sailors violated the U.N. Refugee Convention adopted in 1951 and the Optional Protocol adopted in 1967 and denied the value of the South Korean Constitution, which North Koreans regard as South Korean nationals.
